Terms & Conditions

These Terms and Conditions (“Terms & Conditions”) apply to the HOMAGE Score Rewards Program (as defined below) offered herein, and not to any other website, mobile app, product, service, or program offered by us.  Score Rewards is offered by HOMAGE and/or its subsidiaries, program partners and administrators, and affiliated companies (“HOMAGE”, “our”, “we”, or “us”) through the HOMAGE website Vintage Apparel | Retro & Vintage Clothing | HOMAGE (the “HOMAGE Website”).  These Terms & Conditions are a legal and binding agreement between you and HOMAGE governing your participation in the HOMAGE Score Rewards Program, which includes its content, information, services, and features, and does not alter in any way the terms or conditions of any other agreement you may have with HOMAGE for other products and services, or the terms or conditions of any other promotional offers or programs that may be conducted by HOMAGE from time to time. 

PLEASE READ THESE TERMS & CONDITIONS CAREFULLY, AS THEY APPLY TO YOUR ENROLLMENT AND PARTICIPATION IN THE HOMAGE SCORE REWARDS PROGRAM.  CHECK THESE TERMS & CONDITIONS DAILY FOR UPDATES OR MODIFICATIONS.  BY REGISTERING OR USING A SCORE REWARDS ACCOUNT OR OTHERWISE PARTICIPATING IN THIS HOMAGE SCORE REWARDS PROGRAM OR BY CLICKING TO ACCEPT OR AGREE TO THESE TERMS & CONDITIONS WHEN THIS OPTION IS MADE AVAILABLE TO YOU, YOU AGREE TO BE BOUND BY THESE TERMS & CONDITIONS.  THESE TERMS & CONDITIONS INCLUDE A WAIVER OF CERTAIN RIGHTS, INCLUDING THE RIGHT TO SUE IN COURT OR TO PURSUE A CLASS ACTION. 

IF YOU DO NOT AGREE TO THESE TERMS & CONDITIONS, YOU ARE NOT PERMITTED TO, NOR SHOULD YOU ATTEMPT TO, PARTICIPATE IN THE HOMAGE SCORE REWARDS PROGRAM. 

Privacy

Please review our Privacy Policy located at HOMAGE Privacy Policy (the “Privacy Policy”) to understand our privacy practices, as information collected from you in connection with Score Rewards is subject to the Privacy Policy. In addition to the details outlined in the Privacy Policy, in an effort to provide additional transparency, we have included a brief summary below of certain information that may be collected as a part of Score Rewards. This information may include:

  • Your name
  • Your postal address
  • Your email address
  • Your telephone number
  • Your indication that we are permitted to contact you
  • Your indication that you agree to these Terms & Conditions
  • Your confirmation that you are at least 16 years of age
  • Your birthday month and day

 

By applying for enrollment in, and participating in Score Rewards, you acknowledge that HOMAGE may use your information as described in our Privacy Policy and as otherwise provided in these Terms & Conditions. You agree to review these Terms & Conditions and the Privacy Policy regularly so that you can make informed decisions about your use of and participation in Score Rewards, including the personal information you choose to share with us. You may obtain a copy of our Privacy Policy at any time by emailing [email protected] or by visiting HOMAGE Privacy Policy. 

Modifications

The HOMAGE Score Rewards Program is offered at the sole discretion of HOMAGE.  We reserve the right, in our sole discretion and at any time: (a) to terminate or suspend Score Rewards, in whole or in part; and (b) to add, delete, or otherwise change the Rewards, Offers, point system, perks, and/or these Terms & Conditions, including, but not limited to, changes to prices and charges, changes to the activities by which points may be earned, and changes that may reduce or cancel the redemption value of points earned and credited but not yet redeemed. If we change these Terms & Conditions to provide points for a new activity, no points will be awarded for any such activity that occurred prior to the effective date of the change. HOMAGE may change these Terms & Conditions without prior notice to you, but the current version of the Terms & Conditions will be posted on the HOMAGE Website. 

As mentioned, we may modify these Terms & Conditions from time to time, or terminate Score Rewards altogether. If and when we do, we will notify you by email or otherwise as required under applicable law. It is therefore very important that you update your account information or notify us when your email address changes. Any changes to these Terms & Conditions will also be posted here. Your continued participation in Score Rewards after any modification confirms your acceptance to the modifications. 

In addition, HOMAGE reserves the right to terminate your participation in Score Rewards and to invalidate any and all earned Rewards or other perks and points already earned but not yet redeemed, whether or not credited to or existing in your Score Rewards Account: (a) in the event of any abuse or fraud relating to the earning of points or redemption of Rewards or Offers, and/or any violation of these Terms & Conditions (including, but not limited to, any attempt to sell, exchange, encumber or transfer points or Rewards); or (b) for your failure to meet eligibility requirements. We reserve the right, in our sole discretion, to determine whether termination or disqualification is appropriate. We reserve the right to deny access to your Score Rewards Account or Score Rewards Account history in the event your Score Rewards Account is terminated or suspended. These rights are in addition to any other legal or equitable remedy that may be available to us under applicable law. 

You may terminate your participation in Score Rewards at any time and for any reason by contacting us or by cancelling your Score Rewards Account. If you cancel your Score Rewards Account, any unredeemed points and/or progress towards any Rewards or Offers will automatically expire and will no longer be available for redemption. If you re-enroll at any time, you will start anew, without any points or captured progress towards any Rewards or Offers.  Because we plan communications in advance, it may take several weeks for your cancellation request to become effective. If you continue receiving communications from us after cancelling your Score Rewards Account or otherwise expressing an opt-out preference, please bring the matter to our attention so that we can investigate the matter. 

HOMAGE may, at any time, for any reason, and without notice or liability: (1) suspend, terminate, or modify operation of or access to the HOMAGE Website, Score Rewards, or any portion thereof; (2) change, revise, or modify the HOMAGE Website, Score Rewards, or any portion thereof; (3) interrupt the operation of the HOMAGE Website, Score Rewards, or any portion of the same for maintenance and support; (4) impose limits on certain features of, and services provided in or through, or restrict access to the HOMAGE Website or Score Rewards; and/or (5) terminate the authorization, rights, and license given above. Upon any termination, the rights and licenses granted to you herein shall immediately terminate, and you must cease all use of the HOMAGE Website, including Score Rewards. 

Content & Use

The HOMAGE Website and all content, information, and other materials featured, displayed, contained, and available on Score Rewards (collectively, the “Content”) are owned by or licensed to HOMAGE and are protected by copyright, trademark, trade dress, patent, and/or other intellectual property rights or otherwise under the law.  Subject to your compliance with these Terms & Conditions, HOMAGE grants you a personal, non-exclusive, non-transferable, limited right to access and use the HOMAGE Website and HOMAGE Score Rewards Program for noncommercial purposes only.  You may not, in any way, otherwise copy, reproduce, distribute, transmit, display, perform, reproduce, publish, license, modify, create derivative works from, sell, or exploit, in whole or in part, the HOMAGE Website, Score Rewards, or the Content. 

You agree to use the HOMAGE Website, Score Rewards, and the Content in accordance with these Terms & Conditions and all applicable laws, rules and regulations.  HOMAGE may prohibit access, use, conduct, communications, or content that we, in our sole discretion, deem to be harmful to the HOMAGE Website, Score Rewards, the Content, users, us, our brand, or any other person or entity, or that violates these Terms & Conditions and/or applicable law.  YOU MAY NOT USE OR ACCESS THE HOMAGE WEBSITE OR SCORE REWARDS WHILE OPERATING A VEHICLE.  You must use the HOMAGE Website and Score Rewards only when it is lawful and safe to do so. 

HOMAGE Score Rewards Program

HOMAGE offers the HOMAGE Score Rewards Program (the “HOMAGE Score Rewards Program” or “Score Rewards”) to reward and thank our loyal customers.  Score Rewards is available to enrolled members in the United States.  Points accumulated under Score Rewards are promotional and have no cash value.  There are no membership fees associated with Score Rewards. All questions or disputes regarding eligibility for Score Rewards, accumulation and/or redemption of points, Rewards, and Offers, or a Player’s compliance with these Terms & Conditions, will be resolved by HOMAGE in its sole discretion. 

Eligibility. You may enroll in the Homage Score Rewards Program if you: (1) are a legal resident of the United States; (2) at least 16 years of age at the time you enroll; (3) have an active, valid e-mail address; and (4) are a human being. No corporations, partnerships, limited liability companies, or other legal entities can participate in Score Rewards. Score Rewards is not targeted towards, nor intended for use by, anyone under the age of 16. If you are between the ages of 16 and 18, you may only enroll in Score Rewards under the supervision of a parent or legal guardian who agrees to be bound by these Terms & Conditions. 

Enrollment/Rewards Account. You can enroll in Score Rewards and create a rewards account (“Score Rewards Account”) by: 

  1. Visiting the HOMAGE Website
  2. Clicking the “Account” icon
  3. Clicking “Sign Up Now”
  4. Selecting “Sign in with Facebook”, “Sign in with Google” or “Sign up with Email”
  5. Entering the required information and approving creation of the account (this will automatically enroll you in the Homage Score Rewards Program). 

Or: 

  1. Visiting the HOMAGE Website
  2. Scrolling to the bottom of the HOMAGE Website and selecting “Loyalty Rewards”
  3. Selecting “Score Big”
  4. Selecting “Sign Up Now” under “Need An Account?”
  5. Entering the required information, and
  6. Selecting “Create”.

Score Rewards is open to eligible individuals who establish a Score Rewards Account as set forth above (each, a “Player”, or “you” or “your”).  Some activities may only be available to those who are at least 18 years or age. The HOMAGE Website is intended only for users and Players physically located in the United States. If you are located in the European Union or elsewhere outside of the United States, please do not use the HOMAGE Website or Score Rewards or provide any information to us. Be aware that information we collect will be transferred to and processed in the United States. By using Score Rewards, the HOMAGE Website and/or providing us with any information, you consent to this transfer and processing of information in the United States.  Score Rewards is void where prohibited by law. Participation in Score Rewards constitutes your full and unconditional agreement to these Terms & Conditions. Players whom do not comply with these Terms & Conditions as determined by HOMAGE in our sole discretion may be prohibited from participating in Score Rewards. By participating in Score Rewards, you hereby agree to be bound by these Terms & Conditions and further agree to receive email messages from us regarding the status of your Score Rewards Account, earned points and/or Rewards, Offers, and otherwise as provided herein, in the Privacy Policy, or the HOMAGE Website Terms of Use.

To enroll in Score Rewards, you must register for and create a Score Rewards Account. Creating a Score Rewards Account is free but is subject to HOMAGE’s general Terms of Use, located at HOMAGE Website Terms of Use (the “General Terms of Use”). Capitalized terms used but not defined in these Terms & Conditions shall have the same meanings as defined in the General Terms of Use. To register for and participate in Score Rewards, visit the HOMAGE Website and then follow the links and instructions for registration, which includes a requirement that you must affirmatively agree to these Terms & Conditions. There is a limit of one (1) Scored Rewards Account per person. There is also a limit of one (1) Score Rewards Account per mobile number and email address. Players will be required to provide the requested information, including, but not limited to, user name, password, name, and e-mail address. The person who creates a Score Rewards Account using a mobile number or email account represents and warrants that he or she is the authorized holder of that mobile number and email account, and is authorized to create the Score Rewards Account and provide the requested information to us. 

In order to use and participate in Score Rewards, you must have a compatible device with access to the Internet. HOMAGE makes no representation or warranty that the HOMAGE Website will be compatible with your device.  You are responsible for any devices, software and services needed to access and use the HOMAGE Website. HOMAGE does not guarantee the HOMAGE Website will fully function on any particular device or with any particular software. Without limiting the forgoing, you are also responsible for any messaging and data charges, fees and taxes for your participation in the HOMAGE Score Rewards Program, including, without limitation, when HOMAGE communicates with you by text message (if applicable), email or other means that you choose and earning points or redeeming Rewards. If you create a Score Rewards Account, you are responsible for keeping the Score Rewards Account secure (including protecting your password) and for all activity under the Score Rewards Account. 

As referenced above, certain features or services offered on or through the HOMAGE Website require you to complete a registration process and/or set up an account and login.  In connection with that process and your Score Rewards Account, you agree to (1) provide true, accurate, current, and complete information about yourself, and (2) maintain and promptly update your information to keep it true, accurate, current, and complete. You are entirely responsible for maintaining the confidentiality of the information you hold for your login, including your password.  You agree to notify HOMAGE immediately of any unauthorized use of your login, or any other breach of security. You may be held liable for losses incurred by HOMAGE or any other HOMAGE Website user or Score Rewards Player due to someone else using your Score Rewards Account or login as a result of your failing to keep your login information secure and confidential. 

You may not use anyone else’s Score Rewards Account or login information.  HOMAGE shall not be liable for any loss or damage arising from your failure to comply with these obligations.

Your Score Rewards Account is personal to you and may not be sold, transferred or assigned to, shared with, or inherited by family, friends or others. You may have only one (1) Score Rewards Account. 

As a part of the HOMAGE Score Rewards Program, HOMAGE will send you transactional, informational, and promotional messages and/or offers. These communications may happen in the form of notifications through the HOMAGE Website, email, SMS text messages (if you opt-in) and/or any other ways you may have selected when you enrolled in Score Rewards. If your contact information changes, or if you wish to change your contact information, please log into your Score Rewards Account and update your contact information or preferences. HOMAGE will not contact you by text message without your prior express written consent. We will not charge you for text messages; however, message and data rates may apply. You may opt out of receiving text messages or notifications by following the opt-out instructions included with such messages (e.g., replying “STOP” to SMS messages and “unsubscribing” from email communications).

Qualifying Purchases. You will earn points by making qualified purchases while signed into your Score Rewards Account or by providing the email address linked to your Score Rewards Account if purchasing in-store at an Homage store location. You will earn points as set forth in the following table:

After the qualifying purchase is verified, the points you have earned will be applied to your Score Rewards Account. You can track the points and Rewards you have already earned and that you may earn in the future by logging into your Score Rewards Account.

For your convenience, online orders submitted via the HOMAGE Website while you are logged into your Score Rewards Account will automatically generate points.  Such points may not show up in your account immediately, but they will eventually be displayed following your purchase.

Exclusions. Some exclusions apply. Purchases using HOMAGE gift cards are not considered qualifying purchases and do not accumulate points. Tips, donations, and fees, including without limitation shipping fees, will also be excluded from a purchase total when computing qualifying purchases and do not accumulate points. If you void or cancel a qualifying purchase yet still accumulate points for such purchase, HOMAGE reserves the right to deduct the points associated with that purchase from your Score Rewards Account at any time with or without notice to you.

Rewards. By accumulating points in your Score Rewards Account within a twelve (12) month period of time, you will earn perks (i.e., membership levels), as set forth below, as well as other rewards that may be offered from time to time (each, a “Reward”), which you may redeem (subject to these Terms & Conditions and any terms provided in connection with such other, non-perk rewards). A Reward may not be combined with any other Offer.

You will have the ability to achieve new perks/membership levels throughout your participation in Score Rewards, according to the following table:

Your membership level will remain for one (1) year once achieved from the date such membership level/perk.  On an annual basis thereafter, starting on anniversary date from your enrollment, your membership level will be automatically downgraded one membership level. According to the points you accumulate thereafter, you will have the opportunity to increase your membership level (remember, “Rookies” is the lowest membership level and “Legends” is the highest membership level). Neither earned points nor earned Rewards are transferable.

Redeeming Points for Rewards. To redeem points, follow these steps:

  1. Sign in to your HOMAGE account
  2. Review the Rewards available to you
  3. Choose the Reward for which you would like to redeem points by selecting “Unlock This Reward” under the desired Reward
  4. If you have met the necessary requirements for the selected Reward, clicking “Unlock This Reward” for the desired Reward will allow you to utilize the Reward at your next checkout (e.g., purchase discount/reducing purchase amount) or instantaneously for redemption of/claiming an applicable Reward (e.g., a gift card).

Promotional Offers. Through Score Rewards, HOMAGE may, from time to time and at our sole discretion, provide Players with opportunities to receive various promotional offers, coupons, or other deals (each, an “Offer”). Such Offers may be provided, for any reason or no reason, at random, periodically, seasonally, regionally, or based upon your engagement with Score Rewards, including your order history, personal information provided to HOMAGE, and any other details relating to you, your use of the HOMAGE Website, your participation in Score Rewards, or otherwise as we may determine at our sole discretion. Some Offers may include specific instructions and requirements related to how you may earn the Offer, including, but not limited to, requiring you to first purchase other items before the points or specific Reward are earned. You must follow all such instructions and complete all requirements prior to redeeming an Offer and earning any points or a Reward.

In addition to the terms and conditions provided elsewhere in these Terms & Conditions, without limiting our rights or remedies, the following terms apply to Offers:

  • An Offer may only be available to a Player for redemption through Score Rewards or a specific HOMAGE store location (as specified by the Offer),
  • An Offer may only be available and redeemed for the product as shown or described on or through the Offer,
  • An Offer is subject to availability on the HOMAGE Website and at any HOMAGE store location at which you attempt to redeem the Offer.
  • An Offer may only be redeemed on or before the expiration date.
  • An Offer may only be redeemed once.
  • Certain Offers may not be combined with other purchases or offers (including other Offers).
  • Offers may not be exchanged for cash or other Offers, and have no cash value.
  • The time at which a Player attempts to redeem an Offer may affect the availability of and ability for Player to redeem the Offer (Offers are limited while supplies last).
  • An Offer is not transferrable.

Any additional terms set forth on or through the HOMAGE Website, Score Rewards, an Offer itself or otherwise made available by HOMAGE will apply.

Additional Score Rewards Terms. HOMAGE reserves the right to terminate your Score Rewards Account and/or your participation in Score Rewards if we determine in our sole discretion that you have violated these Terms & Conditions, the General Terms of Use, you have more than one (1) account, or that the use of your account is unauthorized, deceptive, fraudulent or otherwise unlawful. HOMAGE may, in its sole discretion, suspend, cancel, or combine Score Rewards Accounts that appear to be duplicative, and may refuse to allow you to re-enroll in Score Rewards.  HOMAGE also reserves the right to “unregister” and make ineligible for Score Rewards any Score Rewards Account that has been inactive for three (3) years. Inactive is defined as no points earned (excluding birthday points).   

HOMAGE has the right at any time, with or without giving you prior notice, to:

  • End or cancel the HOMAGE Score Rewards Program and/or any specific Offer or Reward;
  • Change any Reward or other Score Rewards benefit we offer;
  • Change the requirements for earning points or a particular Reward;
  • Change the time you have in which to earn points or a particular Reward; and/or
  • Change any other feature of Score Rewards.

If we end the HOMAGE Score Rewards Program, points or Rewards you have earned but not used will expire on the end date, and you may not use any points or redeem any Rewards after the end date.

No Warranties

THE HOMAGE WEBSITE, THE CONTENT, AND THE HOMAGE SCORE REWARDS PROGRAM ARE  PROVIDED  ON AN “AS IS” AND “AS AVAILABLE” BASIS, AND HOMAGE HEREBY EXPRESSLY DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, ACCURACY, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE.  WITHOUT LIMITING THE FOREGOING, HOMAGE DOES NOT GUARANTEE THAT THE HOMAGE WEBSITE, THE CONTENT OR THE REWARDS PROGRAM WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED. 

Limitations of Liability

HOMAGE, its affiliates, subsidiaries, and promotional and advertising agencies are not responsible for any printing or computer error, omission, interruption, irregularity, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alteration of Score Rewards materials, points, or Rewards, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, unauthorized access to Score Rewards Accounts, or inaccurate transmission of Score Rewards or other information due to technical problems or traffic congestion on the internet, at any web site or any combination thereof. 

By participating in Score Rewards, you accept all responsibility for, and hereby release and agree to indemnify and hold harmless HOMAGE and its respective parent companies, subsidiaries, affiliates, agents, promotion and advertising agencies, and each of their respective officers, directors, employees, shareholders, and successors, assigns, and service providers from and against any claims, liabilities, damages, or expenses that may arise from actions taken by you and/or your participation in the HOMAGE Score Rewards Program, or for any harm or injury caused by any third party. 

NOTWITHSTANDING ANYTHING TO THE CONTRARY, UNDER NO CIRCUMSTANCES, INCLUDING WITHOUT LIMITATION HOMAGE’S NEGLIGENCE, SHALL HOMAGE OR ITS AFFILIATES OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH THE HOMAGE WEBSITE, THE CONTENT, OR THE HOMAGE SCORE REWARDS PROGRAM OR PLAYERS USE, OR INABILITY TO USE, SCORE REWARDS, THE HOMAGE WEBSITE, OR THE CONTENT, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT OR OTHERWISE, EVEN IF FORESEEABLE AND NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY REMEDY. WITHOUT LIMITING THE FORGOING, IF HOMAGE IMPROPERLY DENIES A PLAYER ANY POINTS OR REWARD, HOMAGE’S AGGREGATE LIABILITY WILL BE LIMITED TO THE EQUIVALENT FAIR MARKET VALUE OF SUCH POINTS OR REWARD.   

BY PARTICIPATING IN SCORE REWARDS, PLAYER WAIVES ANY AND ALL RIGHTS TO BRING ANY CLAIM OR ACTION RELATED TO SUCH MATTERS IN ANY FORUM BEYOND ONE (1) YEAR AFTER THE FIRST OCCURRENCE OF THE KIND OF ACT, EVENT, CONDITION OR OMISSION UPON WHICH THE DISPUTE IS BASED.  BECAUSE SOME STATES DO NOT PERMIT THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, IN SUCH JURISDICTIONS, LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY SUCH STATE LAW. 

Communications

When you visit the HOMAGE Website or send e-mails or text messages to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail, mail, phone, text message, or by posting notices on or through the HOMAGE Website. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. You further agree that any notices provided by us electronically are deemed to be given and received on the date we transmit any such electronic communication as described in these Terms & Conditions. You acknowledge that messages transmitted via the internet are never completely private or secure, and understand that any message or information you send using the HOMAGE Website or any related service may be read or intercepted by others. 

You acknowledge the methods by which we may contact you, and agree to receive any and all Offers, Rewards, correspondence, transaction confirmations, communications and other information from HOMAGE, whether provided electronically through the HOMAGE Website, your Score Rewards Account or the email address or other information provided by you to HOMAGE. HOMAGE will not be responsible for your inability to connect to the Internet or to access Score Rewards or the HOMAGE Website, or inability to receive electronic communications.  Electronic communications are presumed to be delivered to and received by you when sent by HOMAGE, whether actually received or not. From time to time HOMAGE may monitor and record telephone calls for training or compliance purposes, to provide a record of your instructions or to assure the quality of our service and you hereby consent to the monitoring and recording of your telephone conversations with HOMAGE. In addition, we may periodically use prerecorded voice messages or use an automatic dialing device to make calls and send text messages (if you opt-in) to any telephone number associated with your Score Rewards Account. You agree that we may rely on any oral and electronic instructions from you to us. You are solely responsible for updating the contact information in your Score Rewards Account should there be any change in your name, address (including email address you use with HOMAGE), telephone number, or any other contact information required by HOMAGE for purposes of the HOMAGE Score Rewards Program. 

International Users

The HOMAGE Website and HOMAGE Score Rewards Program is controlled, operated, and administered by HOMAGE from offices within the United States of America. We make no representation regarding use of the HOMAGE Website or Score Rewards outside of the United States. You may not use the HOMAGE Website or Score Rewards or export any portion of either in violation of U.S. export laws and regulations. If you access the HOMAGE Website or Score Rewards from locations outside of the United States of America, you are responsible for compliance with all local laws. 

Governing Law/Venue

The HOMAGE Website and HOMAGE Score Rewards Program are governed by and subject to the laws of the State of Ohio, USA and, where applicable, U.S. federal law, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction and venue of the courts located in the State of Ohio, in each case located in the City of Columbus and Country of Franklin for any disputes arising out of these Terms & Conditions, the HOMAGE Website, and/or Score Rewards. Notwithstanding this provision, you agree that HOMAGE may apply for injunctive or other equitable relief in any court of competent jurisdiction. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.  

You agree that whenever you have a dispute with HOMAGE arising out of or relating to the HOMAGE Website and/or Score Rewards, you will first send a written notice to HOMAGE (a “Demand”). You agree that the requirements of this paragraph will apply even to disputes that may have arisen before you accepted these Terms & Conditions. You must send the Demand to the following address (the “Notice Address”): HOMAGE Score Rewards Program Legal Disputes, 4480 Bridgeway Blvd., Suite A, Columbus, OH 43219. You agree that you will not take any legal action, including filing a lawsuit or demanding arbitration, until 15 business days after you send a Demand to the Notice Address. If the disagreement stated in the Demand is not resolved to your satisfaction within such 15 business days, the remainder of this Section controls. At HOMAGE’s sole discretion, HOMAGE may require you to submit any disputes arising from these Terms & Conditions or Score Rewards, including disputes arising from or concerning their interpretation, violation, invalidity, non-performance, or termination, to final and binding arbitration under the Rules of Arbitration of the American Arbitration Association applying Ohio law. 

General Provisions

All or any of our rights and obligations hereunder may be assigned to a subsequent owner or operator of the HOMAGE Website and/or HOMAGE Score Rewards Program in a merger, acquisition or sale of all or substantially all HOMAGE assets. If, for any reason, a court of competent jurisdiction finally determines any provision of these Terms & Conditions or any portion thereof to be unenforceable, such provision will be enforced to the maximum extent permissible so as to give the intended effect thereof, and the remainder of these Terms & Conditions will continue in full force and effect.  

Any attempt by any person to undermine the legitimate operation of the HOMAGE Score Rewards Program may be a violation of criminal and civil law, and, should such an attempt be made, without limiting our rights or remedies, we reserve the right to seek damages from any such person to the fullest extent permitted by law. Our failure to enforce any term or condition of these Terms & Conditions shall not constitute a waiver of any such term or condition, or any other term or condition. Without limiting our rights or remedies, we shall have the right to take appropriate administrative and/or legal action, including seeking criminal prosecution, as we deem necessary in our sole discretion. 

HOMAGE is not responsible for any incorrect or inaccurate information supplied by Players while participating in Score Rewards. You represent to HOMAGE that all information provided or otherwise made available by you is true, accurate and correct, you have the right to provide and otherwise make such information available, and HOMAGE and its representatives may rely on such information. 

These Terms & Conditions and the General Terms of Use constitute the sole and entire agreement between Player and HOMAGE with respect to the HOMAGE Score Rewards Program and your participation in it, and any and all prior agreements with respect to any other rewards program are superseded by these Terms & Conditions. In the event of a conflict between the terms and conditions of these Terms & Conditions and the General Terms of Use, the terms and conditions of the General Terms of Use shall control. Nothing contained herein limits our rights or remedies under the General Terms of Use. 

All registered marks, trademarks and service marks belong to their respective owners. HOMAGE is a trademark of Homage LLC.  Headings are for ease of reading and do not restrict or alter the meaning of any provision within these Terms & Conditions.
